Car park cameras without permission


We asked Basildon Council whether there was planning permission for the cameras on poles in Edith’s Lane car park. It has been confirmed by Basildon Council that the camera controlling the St Edith's Lane car park needs planning permission but that no such permission has been applied for nor granted. The company concerned are now to apply for retrospective planning permission. BDRA/BAG cannot offer any advice on whether Penalty Notices issued whilst this is the case are legal, but if any resident who has received such a notice seeks to have it overturned on these grounds we'd be interested to know the outcome. We believe a similar situation applies to the Westgate car park at Basildon and note that our MP and Mayor became involved in that case. We find it extraordinary that a professional parking company like Smart Parking didn't know it needed this permission. It has a very similar name to the firm involved at Westgate. Can they be one and the same? When the company does apply for planning permission all residents are able to comment or object and we encourage residents to take advantage of this right. BDRA will be objecting.
